Legal and employment related responsibilities, along with the constitutional conventions entrusted to the Chief Justice are being hindered by the Department of Judicial Administration, claimed Chief Justice Dr. Ahmed Abdullah Didi.
In a statement released by the Chief Justice with regards to the suspension of Supreme Court Director, Athika Ibrahim, the Dr. Ahmed Abdullah Didi said that while there have been no complaints in relation to the violation of any code of conduct of an employee of the judiciary, no issues with regards to the director are even being investigated by the court.
He further expressed his concerns over the attempt of DJA to unduly take disciplinary actions against an employee of the Judiciary. He also added that any actions against an employee should go through fair and natural justice regulations, along with considering the services of the employee in a positive light among other things.
And while Athika was not informed of the charges against her, nor was she given an opportunity to speak in her defense, Dr. Didi described the DJA’s actions as an undue use of power to bully employees. He added that he believes incidents like this would create fear amongst employees in the judicial system and that it could result in the upsetting the jurisdiction of the court.
Summing up the statement, he said that the legal and employment related responsibilities, along with the constitutional conventions entrusted to the Chief Justice are being hindered due to the unlawful actions of DJA, and that he would not let any employee of the Supreme Court be disciplined via an unlawful and undue process.
